Terms and conditions JongLeren.es
1.1 Principal: every natural person or legal person that uses the services of JongLeren.es, including but not to the exclusion of the student.
1.2 Internship company: every recognized internship company, that had contact with JongLeren.es with the intention of offering an internship to Principal within the company.
1.3 JongLeren.es: the intermediary organisation between Principal and the company that provides advice, information and mediation with the purpose to realise contracts between Principal and the provider of the internship, and if necessary the institution of education, in which the concerned parties, Principal and the provider of the internship, and if necessary the institution of education, may declare their agreement.
1.4 External organisations: other service-providers who provide additional of primary services to JongLeren.es.
- In general
2.1 JongLeren.es and Principal are agreeing on the collaboration with the purpose of completing the tasks in mutual agreement based on the terms and conditions and the prices on the website (www.JongLeren.es).
2.2 The terms and conditions can be consulted on the website: www.JongLeren.es
2.3 The Principal and/or Internship company who were contracted with these conditions, will be expected to agree implicitly on the relevance of the agreement at a later point of time.
2.4 Any other possible conditions than these conditions by JongLeren.es, will be rejected.
2.5 In case some of the conditions are annulled or destroyed, the remaining conditions will fully remain in force, and the parties will discuss in order to agree upon substitute conditions, in which the intention and the purpose of the annulled or destroyed conditions will be observed.
2.6 New or deviate conditions will only be declared valid after both concerned parties sign a written agreement.
- Procedure and official contract
3.1 After the Principal filled in the registration form provided with name and e-mail address on the website, JongLeren.es will send a reaction per email. An invitation to a Skype interview follows, whereupon the Principal receives, in case of agreeing with JongLeren.es to mediate prior to an internship, a confirmation and other documentation necessary for the introduction by e-mail. This is considered a quotation for a specific service requested by the principal.
3.2 The principal accepts the collaboration by sending the filled in confirmation to info@JongLeren.es, this can be done by pressing the ‘Send’ button on the e-mail application, the confirmation will be send to and accepted by JongLeren.es.
3.3 The Principal agrees the terms and conditions by ageing on collaboration.
3.4 The principal is responsible to fill in all the forms truthfully, changes can be send by e- mail to info@JongLeren.es.
3.5 we recommend the Principal to subscribe via www.JongLeren.es or contact JongLeren.es.es in another way, within 2 months before the beginning of the internship. This is to see if there are short term possibilities. (Note: consider that every country differ in visa application, request procedure and time necessary.)
3.6 Internships from JongLeren.es are meant for Principal who are 18 years or older on the starting date. The Principal who are not yet 18 years old on the starting date, needs to have permission from their parents or guardian, these will be expected to contact JongLeren.es personally. In that case, all of the further procedures, like contracts, payments and confirmations, will be handled in consultation with the parent or guardian.
- Down payment
4.1 When JongLeren.es confirms that de principal is qualified for mediation, the Principal needs to make a down payment of 50% of the total invoice, this down payment will be send to the account number indicated on the invoice. The invoice will be send by e-mail once the confirmation, resume and the motivation letter is received by JongLeren.es. The down payment will be considered the official confirmation for JongLeren.es to start the mediation and the Principal will agree the collaboration. The down payment will be deducted from the total sum, when the principal and the internship company agree on the internship.
4.2 If JongLeren.es is not able to realize an internship for the Principal before the deadline as mentioned in the confirmation, than the total down payment will be refunded. This refunding will not take place if the Principal turned down two (2) suiting internship possibilities which meets the demands of the Principal as mentioned in the confirmation and the correspondence per e-mail. In case of the Principal withdrawing because of personal reasons, the payment will not be refunded. If the Principal not replies in due time (at least within five (5) days after the last moment of contact) to e-mails or telephone calls, the down payment will not be refunded. It can be notified to JongLeren.es if the Principal is poorly available for a certain period of time. If JongLeren.es is not able to find an internship, and JongLeren.es tries to contact the Principal in order to refund the down payment, the Principal will be expected to reply within six (6) weeks with all the information necessary, for JongLeren.es to refund the down payment.
4.2.1 When the mentioned deadline gives JongLeren.es less than six (6) weeks time to find a suitable internship, the down payment will not be refunded, in case of not finding a suitable internship.
4.2.2 It is possible to decline the first offered internship, whereupon JongLeren.es will search for a second aspirant company for the Principal. In case the first offered internship matches the demands of the Principal the total sum of the down payment will not be refunded, however JongLeren.es will start a second search for another internship.
4.3 In case the Principal withdraws de collaboration due to illness or family circumstances (the passing of a family member in the first or second degree), JongLeren.es will refund the down payment minus 25 euros. In both cases the Principal must submit written evidence. It is the reserved right for JongLeren.es to judge, if the document is legitimate and sufficient. Withdrawal because of change of opinion or insufficient number of study points, will not be noted as a legitimate reason to reclaim the down payment.
4.4 In case of the Principal withdrawing the mediation after the down payment for a reason other than mentioned in paragraph 4.2 and 4.3, JongLeren.es must be notified by the Principal to discuss further action. JongLeren.es reserves the right to withhold the down payment and end the contract. In case of special circumstances, JongLeren.es will refund the down payment after deduction of 75 euros.
4.5 In case the Principal declines the first internship offered by JongLeren.es.es, while this internship matches the demands made by the Principal, JongLeren.es will withhold the down payment. On the request of the Principal, JongLeren.es will find another internship, the down payment does not have to be performed again, but the existing down payment will be withhold.
4.6 If the Principal accepts the internship, after the deadline as mentioned in the confirmation, the down payment will not be refunded and there will be no discount.
4.7 The Principal cannot claim that the internship is granted with an internship fee, if the Principal declines the suited internship with a reason based on lacking an internship fee, the down payment will not be refunded.
- Final payment
5.1 Unless otherwise agreed on both parties, the final payment including the cost of the internship (agreed sum minus the down payment) as stated on www.JongLeren.es, must be made within two (2) weeks after sending the invoice to the Principal.
5.1.1 The final invoice will be send at the time the Principal and the internship company agree on the internship. The confirmation will be send by e-mail.
5.2 If the final payment is not made within two weeks after sending the invoice, JongLeren.es reserves the right to charge 10 euros reminders costs per time. After the third reminder JongLeren.es reserves the right to end the agreement immediately, whereupon both parties has no obligations towards each other. If the Principal did not make his payment after the third reminder, despite signing the contracts, JongLeren.es reserves the right to enable a bailiff to collect the remaining amount of the total invoice. The extra costs will be charged to the Principal. JongLeren.es always reserves the right to decline the internship, in case the payment is not made.
5.3 In case the Principal withdraws de collaboration, due to severe illness or passing of a family member, after making the final payment but before the start of the internship, JongLeren.es will refund the total sum with the exclusion of the down payment. In both cases the Principal must submit written evidence. It is the reserved right for JongLeren.es to judge, if the document is legitimate and sufficient.
5.3.3 If the Principal, after completing the payment but before starting the internship, decides to withdraw for a reason other reasons than stated, it is up to JongLeren.es to decide whether the reason of withdrawal is valid.
5.4 If in collaboration with the Principal a new internship is found in which the location of the internship is different that stated on the confirmation, the Principal will receive a total invoice in which the down payment has been deducted.
5.5 if the internship gets accepted by the Principal after the deadline, as stated on the confirmation, is passed, the Principal still have to pay the total invoice minus the down payment.
6.1 The Principal is responsible to possess the proper travel documents, i.e. visa, valid ID, work permit and proof of the proper vaccination. JongLeren.es will inform the Principal regarding the required documents, applying, paying and receiving the necessary documents are entirely the responsibility of the Principal.
6.2 If the Principal is not able to make the trip or participate in a part of the trip, due to lacking the proper documents, all the consequents are the responsibility of the Principal.
- Altering the internship by the Principal after the start of the internship
7.1 The Principal had the right to submit minor changes in the internship description, in consultation with the internship mentor prior to the start of the internship.
7.2 Minor changes means: changes in relation to the starting and/or ending date of the internship, the function within the company, the topic of the research, etc. which occur during the internship. Minor changes oblige the Principal to remain in the same company, and on the same location. The changes in the terms of the agreement should be notified immediately to JongLeren.es, and will have no financial consequents for both parties.
7.3 Major changes means: changing location, company or cancelling the internship after the start of the internship and the initial agreement of the internship by the Principal via JongLeren.es. The Principal is obliged to end the contract between the Principal and the internship company.
7.3.1 Major changes (as stated by paragraph 7.3) made within the first four (4) weeks of the internship due to lacking the proper information by JongLeren.es towards the Principal, can lead to the refund of the down payment. The Principal can continue the collaboration with JongLeren.es to find an alternative internship company. If the alternative internship company charges a higher fee, then the Principal needs to make an additional payment to meet the total costs of the alternative internship. If the alternative internship company charges a lower fee, JongLeren.es will not refund the difference.
7.3.2 If the Principal submits major changes (as stated by paragraph 7.3) in the internship description later than four (4) weeks after starting the internship, than all the consequents are the responsibility of the Principal, and the collaboration between JongLeren.es and the Principal will be regarded as ended. In that case neither party carries any responsibility toward each other, the Principal is not liable for a refund.
7.3.3 If the Principal submits major changes (as stated by paragraph 7.3) later than four (4) weeks after starting the internship, than JongLeren.es will try to find a new internship within two (2) weeks. This new internship will meet the Principals demands. The Principal can not reclaim the additional fee for mediation.
7.4 3 In case the Principal annuls the internship due to illness or the passing of a family member in the first degree, JongLeren.es will refund the down payment. In both cases the Principal must submit written evidence. It is the reserved right for JongLeren.es to judge, if the document is legitimate and sufficient to stop the internship. The Principal is obliged to end the contract between the Principal and the internship company.
- termination by the internship company
8.1 in case the internship company ends the collaboration between the Principal and the company, due to misbehaviour by the Principal, JongLeren.es will not have obligations anymore, the contract and the reason of the redundancy is an agreement between the Principal and the internship company. In this case JongLeren.es will not refund the Principal.
8.2 When the Internship company terminates the agreement between the Principal and the internship company, due to internal company principals and not due to misbehaviour by the Principal, then JongLeren.es will try to find a similar internship as soon as possible. There will be no extra costs.
- Services JongLeren.es
9.1 During the period JongLeren.es is being occupied with mediation, JongLeren.es does not accept any legal consequences or reliability occurring from collaboration with JongLeren.es. JongLeren.es does not take any responsibility for the agreements between the Principal and the internship company and therefore being the mediator as such. JongLeren.es is in no way responsible for the costs made by the Principal.
9.2 JongLeren.es does not give any guarantee, yet explicitly or tacitly, that the completed application guarantees an internship. About 90% of the registered applicants do get a suitable internship. We can not guarantee that everyone finds a suitable internship. In the case that mediation is not successful, paragraph 5.2 takes effect. In case JongLeren.es does not receive the proper information from the internship company, then JongLeren.es is not responsible for the payments according to paragraph 7.3.1. The implementation of each part of the agreement is the Principals risk. The expenses made by the Principal is the responsibility of the Principal. In case of occurring problems between the Principal and the internship company, JongLeren.es will provide free mediation.
9.3 All complaints concerning the internship, must be report immediately to JongLeren.es.es.
JongLeren.es will categorize the complaints as stated by paragraph 7.1 to 7.4 or 8.1 to 8.2.
9.4 In case the Principal obstructs the mediation due to improper information, deliberately impeding the set goals or deadline (as stated in paragraph 5.2) an additional fee can be added to the total invoice. The height of the amount will be decided by JongLeren.es.
9.5If the applicant abuses the contacts of the potential internship companies for his own benefit (for instance making arrangements beside JongLeren.es about internships) or share this information with third parties (persons or organisations) it is the reserved right for JongLeren.es to invoice the total amount for internship costs and the costs for the suffered reputational damage.
10.1 Barring mandatory provisions of law, JongLeren.es is not bound to any compensation for any damages of any kind, whether directly or indirectly.
10.2 The Principal indemnifies JongLeren.es against any third parties claims.
10.3 In case JongLeren.es is liable, then the liability can never exceed the maximum amount of the agreement. This being subject to intent and purposefully negligence of JongLeren.es
- Applicable law and disputes
11.1 The agreement is subject to Dutch law.
11.2 As far as the adjudication of disputes fall within the competence of a court, it will be settled exclusively by the court within the district in which JongLeren.es is located.
